1. About Akiolab
These Terms of Use and Sale (the “Terms”) govern your access to and use of the Akiolab website located at https://akiolab.com and any related services, content, features, accounts, and purchases offered through the website (collectively, the “Services”).

We reserve the right, in our sole discretion, to:
- refuse or cancel any order;
- limit quantities per customer, household, address, or order;

Unless otherwise required by applicable law, title and risk of loss for physical goods pass to you upon delivery to the shipping carrier or, if applicable, upon delivery to the address you provided.

- aerospace, aviation, automotive safety-critical, or military uses;
- any application where material failure could result in death, personal injury, or significant property damage.
You are solely responsible for testing suitability, print settings, storage conditions, end-use performance, and fitness for your intended application.
12. Acceptable Use
You may not use the Services:
- for any unlawful, fraudulent, deceptive, or harmful purpose;
- to interfere with or disrupt the website, servers, payment systems, or related infrastructure;
- to scrape, crawl, copy, reproduce, republish, or commercially exploit website content without our prior written permission;
- to upload, transmit, or post malicious code, spam, false reviews, or infringing content;

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:
- THE WEBSITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE;

- THE WEBSITE OR SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR
- ANY PRODUCT WILL BE SUITABLE FOR YOUR PARTICULAR PRINTER, SETTINGS, PROJECT, OR END USE.
THIS SECTION APPLIES ONLY TO THE EXTENT PERMITTED BY LAW AND DOES NOT LIMIT ANY NON-WAIVABLE CONSUMER RIGHTS OR ANY EXPRESS WARRANTY WE PROVIDE IN WRITING.
19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AKIOLAB AND ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SERVICES, PRODUCTS, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES, PRODUCTS, OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY TO THE EXTENT SUCH EXCLUSION OR LIMITATION IS PROHIBITED BY LAW, INCLUDING LIABILITY THAT CANNOT BE LIMITED FOR CONSUMER PROTECTION REASONS.
20. Indemnity
You agree to indemnify, defend, and hold harmless Akiolab and its owners, officers, employees, contractors, affiliates, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or relating to:
- your breach of these Terms;
- your misuse of the Services or products;
- your violation of any law or third-party right; or
- your User Content.
This indemnity applies only to the extent permitted by applicable law.
21. Force Majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, fire, flood, severe weather, war, terrorism, labour disputes, carrier disruptions, supply shortages, pandemics, government action, cyber incidents, or power or telecommunications failures.
22. Governing Law and Jurisdiction
These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein, without regard to conflict of laws principles.
Subject to any rights you may have under mandatory consumer protection law, you agree that any dispute arising out of or relating to these Terms, the Services, or products purchased from us shall be brought exclusively before the courts of Nova Scotia, Canada.
